The Ohio 3rd District Court of Appeals will hear oral arguments in two cases in the Moot Court Room of Ohio Northern University’s Pettit College of Law on Tuesday, Jan. 13, at 10 a.m.

Judges Richard Rogers, Stephen Shaw, Vernon Preston and John Willamowski, sitting in panels of three, will hear the oral arguments in two cases pending before the Court of Appeals. Rogers, Shaw and Willamowski are alumni of Ohio Northern’s College of Law.

The first case to be heard by the judges, the State of Ohio v. Kandale Harrison, originated from Logan County. On appeal, Harrison is arguing that he was denied due process and a fair trial based on the denial of his motion to suppress evidence. He also raises several individual assignments of error relating to the sufficiency of evidence in his case and the effective assistance of counsel. In May 2014, Harrison was convicted of complicity to possess drugs following a jury trial. He was later sentenced to 30 months of incarceration.

The judges will hear a second oral argument in a civil case from Allen County, Charles Daley, et al. v. Eileen Fryer, et al. This is an appeal from the judgment entered by the Allen County Court of Common Pleas in October 2014. The court granted summary judgment in favor of defendants. Plaintiff, Charles Daley, was injured when he slipped on the sidewalk outside of Canal Pharmacy on January 13, 2011.

At the conclusion of oral arguments, the appellate judges will take questions from the audience.

The appellate court’s special session at the College of Law is part of an educational outreach program that gives students, educators and the public the opportunity to enhance their understanding of the appellate process. The appellate court, based in Lima, Ohio, is comprised of 17 counties and travels among them for special court sessions.
